====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 25-02-2026 Heard learned counsel for the petitioner, learned APP for the State and learned counsel appearing for the informant.

2. The petitioner seeks bail in a case registered for the offence punishable under Section 96 of B.N.S.

3. As per the prosecution case, petitioner along with coaccused person are alleged to have kidnapped the minor daughter of the informant by enticing her. Further, informant suspects that the accused persons may sell his minor daughter for prostitution.

4. Learned counsel for the petitioner submits that the present case arises out of a love relationship between the petitioner and the victim and upon recovery the statement of the victim girl was recorded under Section 183 of B.N.S.S wherein she has clearly stated that since her father wanted to get her married elsewhere, she

No.81930 of 2025(4) dt.25-02-2026 2/2 had left her house after calling the petitioner and went to Delhi from where she came back after two days and then again went to Banaras and got married on 09.03.2025. She also admits that she was staying in her matrimonial house and is also two months pregnant. Further, she has also stated that compromise has also been arrived at between her parents and in-laws. The victim has also refused her medical examination. Petitioner is in custody since 09.09.2025. Petitioner is a young boy aged about 18 years with no criminal antecedent.

5. Learned APP for the State and learned counsel for the informant have also been heard.

Taking into consideration the facts and circumstances of the case and also considering the possibility of a love affair and the statement of the victim under Section 183 of the B.N.S.S, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Mohania P.S. Case No. 178 of 2025.
