The petitioner is accused in connection with Durgawati P.S. Case No. 218 of 2019, registered under Sections 302 and 201/34 of the Indian Penal Code and later on, Sections 396, 412 and 120(B) of the Indian Penal Code have been added. Learned counsel for the petitioner submits that it would appear from the FIR that on the basis of Fradebyan of Choukidar, Mahendra Ram, Durgawati P.S. Case No. 218 of 2019 was instituted against unknown but in course of investigation, co-accused, Lalbabu Baitha, was apprehended on 08.09.2019, who confessed his guilt disclosing the name of seven others including the petitioner having hand in the murder

Patna High Court CR. MISC. No.74061 of 2019(3) dt.17-03-2020 2/2 of deceased, Afjal Khan. It is further submitted that similarly situated co-accused, Anuj Kumar and Md. Hussain Ali @ Hussain Ali, whose names have also come in the confessional statement of Lalbabu Baitha, have already been granted privilege of bail by a Bench of this Court vide orders dated 29.01.2020 and 13.01.2020, respectively, passed in Criminal Misc. No. 70692 of 2019 and Criminal Misc. No. 76905 of 2019. Further submission is that petitioners have no criminal antecedent and are in custody since 09.09.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Durgawati P.S. Case No. 218 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
