Petitioner seeks bail in Nasriganj P.S. Case No. 188 of 2018 registered for the offence punishable under Section 366A of the Indian Penal Code.

Informant is the father of victim who has alleged that on 09.08.2018 at about 7:00 pm his minor daughter went outside but even after much search she could not be located and he came to know that petitioner has kidnapped her with intention to marry her. The girl was recovered same day at about 11:00 pm from Mahabir Mandir and her statement was recorded under section 164 of the Cr.P.C in which she has denied kidnapping or forceful marriage with the petitioner rather she has stated that the petitioner is like his brother. Petitioner has got no criminal antecedent and is in custody since 10.08.2018.

No.67939 of 2018(2) dt.28-11-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate-Bikramganj, Rohtas in connection with Nasriganj P.S. Case No. 188 of 2018, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
