The petitioner seeks bail in connection with Maharajganj P.S. Case No. 256 of 2019 dated 17.10.2019 instituted for the offence under Sections 30(a), 36, 41(1) of the Bihar Prohibition and Excise Act, 2016.

It appears that 2.5 litres of country made liquor has been recovered from the house of the petitioner. The petitioner is stated to be in custody since 25.09.2019 and is a person of clean antecedents. It has been submitted that the house in question is occupied by several persons and therefore the petitioner cannot be said to be in exclusive possession of the recovered consignment of liquor.

No.74222 of 2019(2) dt.11-12-2019 2/2 Considering the aforestated facts the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned IInd Additional Sessions Judge-cumSpecial Judge, Excise, Siwan in connection with Maharajganj P.S. Case No. 256 of 2019.
