2. The petitioner seeks bail in connection with Kudra PS Case No.369 of 2024 dated 06.10.2024, instituted for the offence punishable under Sections 96 of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he enticed away the minor daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner submits that the victim herself eloped with the petitioner has come back to home after one year. She is major. Statement of the victim has been

No.79251 of 2025(2) dt.19-11-2025 2/2 recorded under Sections 180 and 183 of the Bharatiya Nagrik Suraksha Sanhita, 2023, wherein, she she has not supported the prosecution case. She has stated that she is pregnant and she wants to live with her husband i.e., the petitioner. Presently, she is residing with her in-laws i.e., parents of the petitioner. Petitioner is in custody since 19.09.2025 having clean antecedents.

5. Learned APP has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District &Sessions Judge-VI cum Special Judge, POCSO Act, Kaimur at Bhabua, in Kudra PS Case No.369 of 2024.

7. The application stands allowed.
