2. The petitioner seeks regular bail in connection with S.Tr. No. 95 of 2018 arising out of Shyampur Bhatah P.S. Case No. 45 of 2012, G.R. No. 353 of 2012 dated 29.06.2012, lodged under Sections 302 and 34 of the I.P.C. read with Section 27 of the Arms Act, 1954.
3. This is a case of misuse of bail.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 11.09.2023 having clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case, this bail application is allowed.

7. Let the petitioner above named, be granted bail only after framing of charge, if the same has not been framed, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned S.Tr. No. 95 of 2018 arising out of Shyampur Bhatah P.S. Case No. 45 of 2012, G.R. No. 353 of 2012, subject to the condition that the petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond shall be cancelled by the Court below.
