2. The present restoration application has been filed for restoration of Cr. Misc. No. 52946 of 2022, which stood dismissed due to non-compliance of peremptory order dated 15.12.2022. By the said order, two weeks time was allowed for issuance of notice to opposite party no. 2.

3. Learned counsel for the petitioner submits that he has already filed requisites for issuance of notice, but after expiry of peremptory time. He further submits that opposite party no.2 has already appeared through her counsel by filing vakalatnama.

4. In view of submission made by learned counsel for the petitioner, this restoration petition is allowed.
