This application for anticipatory bail arises out of Daudnagar P.S. Case No. 300 of 2018, disclosing offences under Sections 341, 323, 307, 379, 354, 504 and 498A of the Indian Penal Code.

The petitioners are wife and sons of the elder brother of the husband of one Heena Parveen. The sister of said Heena Parveen is the informant and has alleged that Heena Parveen was married nearly two years ago. Her family members used to torture her in various ways as she had not been blessed with any child.

Learned counsel, appearing on behalf of the informant,

Patna High Court Cr.Misc. No.70285 of 2018(2) dt.18-12-2018 2/2 has opposed the prayer for grant of anticipatory bail and has submitted that because of the act of cruelty done by the accused persons, the petitioner does not deserve the privilege of anticipatory bail.

However, considering the nature of accusation, this application is allowed. Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned S.D.J.M., Daud Nagar, Aurangabad in Daudnagar P.S. Case No. 300 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
