Mr. Parmanand Prasad ====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 10-07-2025 Heard learned counsel for the petitioner and learned APP for the State. Despite repeated calls, no one appears on behalf of the opposite party no. 2.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 498A, 406, 420, 471, 384, 376, 120B, 307, 494/34 of the Indian Penal Code.

3. The allegation in the complaint which was forwarded under Section 156(3) of the Cr.P.C. for institution of an FIR. There is an allegation of demand of dowry and torture and also an allegation for pressurizing the wife for abortion of child. Petitioner is the husband of opposite party no.2.

Learned counsel for the petitioner submits that the allegations made in the complaint/FIR are not correct and the marriage between the petitioner and the informant was performed on 09.11.2016 and the informant had concealed the fact that she was already married in the year 2013 itself. It has further been submitted that the informant has also got married now for the third time. It is only for the purposes of grabbing the property of the petitioner that the present false case has been filed and as a matter fact, after investigation charge-sheet in this case has been submitted against the petitioner on 16.04.2024 under Sections 498A read with Section 34 of the IPC and not under the other sections which was initially levelled against the petitioner.

5. Learned APP for the State, however, opposes the grant of anticipatory bail.

In such view of the matter, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Manjhagarh
