The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 354B, 379, 504, 506/34 of the Indian Penal Code. Prosecution case is that on 11.09.2019 at about 8.30 PM, the daughter of informant, Soni Praveen with her mother had gone to visit festival of Moharram at Aerodrome road. In the meantime, 8-9 persons, named in the FIR, riding on motorcycle came there. Accused Guddu Rangeela was trying to take away the daughter of informant. Daughter of the informant

Patna High Court CR. MISC. No.73195 of 2019(3) dt.05-03-2020 2/3 raised alarm. Accused muffled her mouth. The wife of informant raised alarm then accused Guddu Rangeela thrashed the wife of informant on ground. In the meantime, elder son of informant went there to save his sister then Guddu Rangeela assaulted him with knife from which son of informant sustained injury on his nose. Knowing about the occurrence informant went there. Accused persons started assaulted the informant. Accused persons snatched Rs. 1100/- from the pocket of informant. The younger son of informant reached there. Md. Ashad and Md. Afsar assaulted with pointed weapon to son of informant. Accused persons also snatched silver chain of son of informant.

They also threatened the informant the villagers present there chased Guddu Rangeela then leaving the daughter of informant, accused persons fled away from there. Guddu Rangeela is chasing the daughter of informant from some days ago. Learned counsel for the petitioners submits that the informant is the uncle of the petitioner no. 1 Guddu Rangeela. Informant had proposed for marriage of Soni Praveen with petitioner no. 1 but the family members of Guddu Rangeela denied from that proposal. Informant has filed the present false case composing a false story. Petitioner no. 2 is the friend of petitioner no. 1 whereas petitioner no.

After perusal of the case diary, I find that petitioner Guddu Rangeela conspiring with other accused persons, was trying to abduct the daughter of the informant and on protest, accused persons assaulted the family members of informant and his daughter.

Considering the nature of allegation, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, their payer for anticipatory bail is rejected in connection with K. Nagar P.S. Case No. 353 of 2019 pending before the court of the learned Chief Judicial Magistrate, Purnea.

Accordingly, the application is dismissed. However, petitioners are directed to surrender before the learned court below and learned court below will consider the regular bail of the petitioners on the same day without being prejudiced by the present order.
