This is the second attempt on behalf of the petitioner for grant of anticipatory bail in connection with Madanpur P.S. Case no.278 of 2022, registered u/s 409, 420, 385 of the IPC. 3.
It is submitted by learned counsel for the petitioner that one of the co-accused namely Ram Swaroop Ram has been granted anticipatory bail vide order dated 11.10.2023 passed in Cr. Misc. No.60806 of 2023, as such, petitioner, whose case stands on similar footing, may be granted the privilege of anticipatory bail.

Learned APP for the State opposed the prayer of the petitioner for grant of anticipatory bail, in view of the recent decision of the Supreme Court in the case of G.R. Ananda
Patna High Court CR. MISC. No.1346 of 2024(2) dt.12-01-2024 2/2 Babu vs. State of Tamil Nadu and Another, reported in 2021 SCC OnLine SC 176, whereby it has been held that second anticipatory bail application is not maintainable. 5.
Considering the decision of the Apex Court in the case of G.R. Ananda (supra) I am not inclined to entertain this second anticipatory bail application of the petitioner. It is hereby rejected.

However, the petitioner is still at liberty to surrender before the learned Court below within four weeks from today and seek regular bail and the learned Court below would pass order, preferably, on the same day, without being prejudiced of this order, in accordance with law.
