====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with Dariyapur P.S. Case No. 373 of 2018 registered for the offence punishable under Sections 392 of the Indian Penal Code. As per FIR, allegation is that the informant was assaulted by fists by some miscreants and looted Rs. 2,76,000/- from the informant. Name of the petitioner transpires during investigation and apart from that he is an accused in nine other cases.

Submission of the learned counsel for the petitioner is that the petitioner is not named in the FIR. His name has surfaced in the case merely on the basis of confessional statement made by co-accused. Except confessional statement, there is nothing against him. The petitioner is in custody since 16.08.2019.

Considering the submissions made by both the parties and in view of the facts stated above, I am not inclined to grant regular bail at this stage. However, the petitioner shall be at liberty to renew his prayer for bail after framing of the charge. Accordingly, this application is disposed of. (Vinod Kumar Sinha, J) uma/- U T
