JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the State. This is an application for grant of Anticipatory Bail in connection with Bihta P. S. Case No. 610 of 2019, registered for the offences punishable under Sections 147, 149, 341, 323, 324, 447 and 379 of the Indian Penal Code.

The allegation is regarding accused persons including the petitioners having assaulted the informant with lathi and are stated to have snatched Gold Mangal Sutra from the neck of the wife of the informant.

The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case

Patna High Court CR. MISC. No.76136 of 2019(2) dt.25-11-2019 2/2 on account of raising of a mud wall and in fact, no incident as alleged has ever taken place. The fact is that no injury has been sustained by the informant and his wife. It is further submitted that the petitioners are having a clean antecedent. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on Anticipatory Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of leaned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Bihta P. S. Case No. 610 of 2019, subject to the conditions as laid down under Section 438(2) of the CrPC. (Mohit Kumar Shah, J) Rajeev Kumar/- U T
