The petitioner seeks regular bail in connection with Bhagwan Bazar P.S.Case No.391 of 2017 dated 11.10.2017 registered for offences punishable under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)A/26/35 of the Arms Act.

Police on information of preparation of dacoity by the miscreants, raided the place of the occurrence, arrested some accused persons and there was recovery of country-made pistol, cartridges and mobile from them. Petitioner was not arrested and later on his name transpired on the confession. It further appears that he is accused in four other cases. Almost all are of similar of nature.

Submission of the learned counsel for the petitioner is that there is no recovery from him. He in in custody for almost

Having heard both sides and in view of submissions as made above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Bhagwan Bazar P.S.case No.391 of 2017 with condition that he has to appear before the police station of his local area for a period of nine months in the second week of each month so that the police may watch his activities and conduct and if he is found actively involved in any serious nature of cases, prosecution is at liberty to move for cancellation of his bail bond.

Let a copy of this order be communicated to the S.P., Saran at Chapra for the needful.

Accordingly, this application is allowed.
