JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 The petitioner seeks bail in connection with Narari Kala Khurd P.S.Case No. 33 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 . Allegation is of recovery of 200 litres of country made liquor from a vehicle and petitioner was found sitting in the vehicle.

Submission of learned counsel for the petitioner is that three persons were arrested from the vehicle and one of them has been granted bail by a co-ordinate Bench of this Court vide order dated 27.11.2018 passed in Cr. Misc. No. 68950 of 20178 and petitioner having no criminal antecedent, has been in custody for since 29.09.2018.

No.71803 of 2018(2) dt.07-12-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-VII-Cum-Special Judge (Excise), Aurangabad in connection with Narari Kala Khurd P.S.Case No. 33 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
