The petitioner seeks regular bail in connection with Spl. Case No.784 of 2019 arising out of Araria P.S.Case No.483 of 2018 dated 20.6.2019 registered for offences punishable under Sections 30(a)/36 of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 31 ltrs. of liquor from the possession of the petitioner. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, having no criminal antecedent and he is in custody for three months. Charge sheet has already been submitted as such there is no chance of tampering with the evidence.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge cm Special Judge, Araria in connection with Spl. Case No.784 of 2019 arising out of Araria P.S.Case No.483 of 2019.. With the aforesaid observation, this application is allowed.
