====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-01-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 406, 467, 468 and 471/34 of the Indian Penal Code.
3. Prosecution case, in brief, is that Abhishek Kumar and his wife Ramawati Devi (Petitioner) along with Rahul Kumar Chauhan and others have established a company namely Enormous Industries Ltd and by making fraud they have collected about a sum of Rs. 1.5 crore from the public. The present petitioner and the informant was agent for collecting the said money from public and finally all of them have embezzled rupees 1.5 crore. Again in the year 2017 the said company has got 1.25 crore and 1.20 crore rupees by selling the land but the said amount also embezzled by the petitioner and co-accused persons.
4. It is submitted by learned counsel for the petitioner that
Patna High Court CR. MISC. No.82900 of 2023(2) dt.05-01-2024 2/2 petitioner is quite innocent and has committed no offence as alleged. No such occurrence as alleged ever took place. He has been falsely implicated in this case. He further submits that petitioner not holding the executive post of the alleged company. Petitioner is a lady and mother of minor child. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
5. Learned APP for the State opposed the prayer for bail.
6. Having regard to the facts and circumstances of the case, considering the fact that petitioner is a female, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Bihiyan P.S. Case No. 437 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
