Despite service of notice, no one appears on behalf of opposite party no.2, The petitioner apprehends his arrest in connection with Complaint Case No. 266(C)/2016 for offences under Sections 379, 386, 384, 323, 448, 120B and 498A of the Indian Penal Code, Section 27 of the Arms Act; and Section 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that he has instruction that opposite party no.2 has got remarried with another person and she has lost interest in pursuing the case.

Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Complaint Case No. 266(C)/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
