The petitioners are accused in connection with Paraiya P.S. Case No. 71 of 2012, registered under Section 406/34 of the Indian Penal Code.

The accusation is that Rs.37,500/ was allotted to both petitioners, being the Chairman and Secretary of welfare group, for construction of pump house but the work of pump house was not completed.

Learned counsel for the petitioners submits that, in fact, Rs.37,500/- was received by both petitioners for construction of pump house against estimated cost of

No.73488 of 2019(3) dt.06-03-2020 2/2 Rs.45,000/- but the work of Rs.34,598/- was done and the remaining Rs.2,902/- was return, which would appear from letter no. 1521 dated 22.10.2019 (annexure 2 to the petition) of the Block Development Officer, Paraiya. It is further submitted that both petitioners have no criminal antecedent and are in custody since 03.10.2019.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Paraiya P.S. Case No. 71 of 2012. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
