2. The petitioner seeks bail in connection with Phulwarisharif P.S. Case No. 1254/2023 registered for the offence punishable under Sections 364(A) of the Indian Penal Code.

3. The petitioner is accused of kidnapping one Akshay Kumar.

4. It has been submitted by the learned counsel for the petitioner that Akshay Kumar used to take money from gullible persons in the name of provide job. He had taken Rupees Fifteen Lakhs from Amit Kumar for providing a job. It was not a case of kidnapping, but it is a dispute for recovery of amount taken by the prosecution side. Case No. 696 of 2023 has been registered against the prosecution side under Sections 420/419/467/468/471/34 of the Indian Penal Code as it has been found that the prosecution side is involved in cyber fraud and other kind of forgery.

5. Chargesheet has been submitted. The petitioner is in jail since 29.08.2023.

6. Considering the aforesaid, this application is allowed.

7. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, XIV, Patna in connection with Phulwarisharif P.S. Case No. 1254/2023.
