The petitioners seek bail in connection with Bangaon P.S. Case No. 44 of 2018 instituted for the offence under Section(s) 366(A) of the Indian Penal Code and Section 4 of the POCSO Act.

The petitioners are in custody since 4.6.2018. In the written report, it is alleged that 13 years old daughter of the informant had gone to school and did not return. The informant learnt during search that she was seen on tempo along with this petitioners who are husband and wife and other accused persons.

Learned counsel for petitioners submits that at

Patna High Court Cr.Misc. No.72928 of 2018(4) dt.09-01-2019 2/2 paragraph nos. 11,12 and 13 of the case diary independent witnesses have stated that victim girl had love affairs with one Shivam Kumar Sharma. There is no any involvement of these petitioners who are elderly person. They have no concern with the aforesaid Shivam Kumar Sharma.

Petitioners have no criminal antecedent.

Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge, Saharsa in connection with Bangaon P.S. Case No. 44 of 2018 corresponding to POCSO Case No. 22 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) shyambihari/- U T
