The petitioner has prayed for bail in connection with Mahesh Khoot P.S. Case No. 127 of 2019 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act.

As per allegation in the FIR, 88.2 litres of IMFL is said to have been recovered from a new car of petitioner no. 2. It is submitted by learned counsel for the petitioners that the allegation of recovery is false and concocted and petitioners have been falsely implicated in this case. In fact, petitioner no. 2 is engaged on bottling of mineral water.

Patna High Court CR. MISC. No.75647 of 2019(2) dt.27-11-2019 2/2 Petitioners are in custody since 29.09.2019 and have no criminal antecedent. It is further submitted that case of the petitioners stand on similar footing to that of the co-accused who have been granted bail vide order dated 25.11.2019 passed in Cr. Misc. No. 75178 of 2019.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise) Khagaria in connection with Mahesh Khoot P.S. Case No. 127 of 2019.
