Petitioners seek bail in Teghra P.S. Case No. 356 of 2018 registered for the offence punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016. Allegation is recovery of 5896.100 Litres of foreign liquor from the Truck parked in the house of Sanjeev Kumar Singh and on seeing the police accused started fleeing away from the place and driver and co-driver of the Truck were arrested who disclosed that Sanjeev Raman and his associate traders had fled away and accordingly 14 persons were made accused in this case. Petitioner no. 1 is wife and petitioner no. 2 is son of Sanjeev Raman and are not at all concerned with the alleged offence and have been falsely implicated in this case

Patna High Court Cr.Misc. No.69827 of 2018(2) dt.03-12-2018 2/2 only for the reason that real culprits have fled away from the place of occurrence. Petitioners have got no criminal antecedent and are in custody since 19.09.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 2nd cum Special Judge, Begusarai, in connection with Teghra P.S. Case No. 356 of 2018, with following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioners shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.

(4) If the petitioners are found involved in similar nature of offences, after their release on bail the trial court shall take steps to cancel their bail bonds.
