JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 Earlier the prayer for bail of the petitioner was dismissed vide order dated 18.09.2017 passed in Cr. Misc. No. 37898 of 2017 in connection with Jhajha P.S. Case No. 292 of 2016 and there is allegation against the petitioner is of recovery of one country mad rifle along with two cartridges. It has been submitted on behalf of the petitioner that in spite of direction to the trial court to conclude the trial within a period of nine months but the same has not been concluded and the petitioner has been languishing in judicial custody for two years.

Heard learned A.P.P. also.

Having heard both sides, from perusal of the impugned order, it appears, that charge has been framed in this

Patna High Court Cr.Misc. No.69699 of 2018(2) dt.12-12-2018 2/2 case on 24.05.2017 and already four witnesses have been examined. It further appears that allegation against the petitioner is under various sections of I.P.C, under Arms Act as well as under U.A.P. Act, as such, I am not inclined to enlarge the petitioner on bail.

This application is accordingly dismissed.

However, since the petitioner has been in custody since long, the trial court is directed to expedite and conclude the trial as early as possible even by conducting the trial on day to day basis.
