This application for anticipatory bail arises out of Chhatauni P.S. Case No.06 of 2017, disclosing offences under Sections 323,327,341,379,384,387,406,420/34 of the Indian Penal Code and Section 27 of the Arms Act.

The main allegation is against accused Awanish Kumar Singh and Harendra Singh, who, it is alleged, were running an academy in the name of 'S.R. Marytime' and based on giving false assurance for providing job, they were collecting money from the youth of the area. It is alleged that the petitioner was assisting the activities of said two accused persons.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.73002 of 2018(2) dt.19-12-2018 2/2 submits that he was not at all associated with the said two persons and he has been implicated because at some point of time, he had intervened in the dispute between the said two persons and some job aspirants.

Considering the above submission, this application is allowed. Let the petitioner above-named, in the event of his arrest/surrender within six weeks from today, in the court below be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari in Chhatauni P.S. Case No.06 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
