03-12-2018 Heard Sri Lalan Kumar Verma, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 31-07-2018 in Narkatiaganj (Rail) P.S. Case No. 63 of 2018 registered for offence under Section 401 of the Indian Penal Code, has prayed for grant of bail.
Learned counsel for the petitioner submits that petitioner was falsely implicated by the rail police on an accusation of recovery of one old small knife and Rs. 30/- (thirty). He further submits that petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the petition.
Considering the nature of accusation, clean antecedent
Patna High Court Cr.Misc. No.70727 of 2018(2) dt.03-12-2018 2/2 as well as period of custody, let the petitioner namely Najre Alam be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Railway Bettiah (West Champaran) in connection with Narkatiaganj Rail P.S. Case No. 63 of 2018.
