====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sadar P.S. Case No.417 of 2018 registered under Sections 399, 402 and 414 of the Indian Penal Code besides Sections 25(1-b)A, 26 and 35 of the Arms Act, pending in the court of the Chief Judicial Magistrate, Muzaffarpur.

The accusation is that on receiving secret information regarding the assemblage of the miscreants for the purpose of committing dacoity, the informant being the Officer Incharge of Sadar Police Station, District-Muzaffarpur, reached in villageJagarnath Patahi, where four persons including the petitioner were apprehended. On search, the petitioner was found in

Patna High Court Cr.Misc. No.71421 of 2018(2) dt.06-12-2018 2/2 possession of two country made pistols and 15 live cartridges, whereas Kanahai Kumar Thakur was found in possession of two live cartridges, Brajesh Kumar was found in possession of one knife and Chandan Kumar was found in possession of two live cartridges.

Learned counsel appearing on behalf of the petitioner submits that while the petitioner is accused in seven other cases, as detailed in paragraph-3 to this application, but in six cases he is on bail. In the present case, the petitioner is in custody since 17.06.2018.

Having regard to the facts and the circumstances of the case as also considering the nature of offence and criminal antecedent of the petitioner, I am not inclined to release the petitioner on bail for the present. Accordingly, the prayer of the petitioner for grant of bail stands rejected. (Rajendra Kumar Mishra, J) P.S./- U T
