JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Garkha P.S. Case No. 247 of 2018 (S.Tr. No. 640 of 2018) for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 15.06.2018. He submits that informant has named the petitioner only on the basis of information, which he has gathered as hearsay, as to the involvement of this petitioner in the commission of crime. He submits that there is no witness to the occurrence and except confessional statement there is no other material against the petitioner.

Case No. 247 of 2018 (S. Tr. No. 640 of 2018).
