The petitioner seeks regular bail in connection with Mashrakh P.S.Case No.211 of 2018 dated 28.6.2018 registered for offences punishable under Sections 413 and 414 of the Indian Penal Code.

Allegation as per FIR is that the police received information that a criminal is moving in the market and thereafter he arrested the accused and recovered the stolen motorcycle and thereafter on his information two motorcycles were recovered from the house of the petitioner. Submission of the learned counsel for the petitioner is that he is cousin brother of Vishal Kumar and on his confession , recovery has been made from the house of the petitioner and

Patna High Court Cr.Misc. No.71302 of 2018(3) dt.18-12-2018 2/2 Vishal Kumar had kept the motorcycle in his house but he had no knowledge that the same is stolen one. He has no criminal antecedent and he is in custody for more than four months. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM IV, Saran Chapra in connection with Mashrak P.S.Case No211 of 2018. With the aforesaid observation, this application is allowed.
