The petitioner seeks regular bail in connection with Kahalgaon, P.S. Case No. 447 of 2015, registered for the offence punishable under Sections 399, 402 and 414 of the Indian Penal Code.
The allegation is regarding the police having received secret information that some criminals had assembled at the alleged place of occurrence and were planning to commit some crime whereafter the police had conducted a raid and the petitioner and other co-accused persons were arrested. It is further alleged that as far as the co-accused person, namely, Raja Kumar is concerned, one loaded country made pistol was recovered from him, apart

The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case, he is having a clean antecedent and no illicit arms have been recovered from the petitioner herein. Lastly, it is submitted that the petitioner is languishing in custody since 22.10.2015.
Having regard to the facts and circumstances of the case as also considering the long incarceration of the petitioner, I deem it fit and proper to grant the privilege of regular bail to the petitioner herein.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. IX, Bhagalpur in connection with S.T. No. 187 of 2016 arising out of Kahalgaon P.S. Case No. 447 of 2015.
