====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-01-2024 Heard Mr. Alok Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Lakshmikant Sharma, learned APP for the State.

2. The petitioner seeks pre-arrest bail in connection with Bihariganj P.S. Case No. 19 of 2023 registered for the offence punishable under Sections 323, 341, 379, 354B, 504, 325 and 506/34 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., petitioner and other members of his family have assaulted the informant and snatched golden chain worth Rs.50,000/- and have outraged her modesty.

4. Learned counsel appearing on behalf of the petitioner submits that there is long standing land dispute between the parties and both the parties have engaged on several occasions in lodging case and counter case. He submits that no

Patna High Court CR. MISC. No.928 of 2024(2) dt.24-01-2024 2/2 such incidence has taken place. Petitioner's side has also lodged Bihariganj P.S. Case No. 03 of 2023. He further submits that the petitioner has himself apologized for the incidence which has taken place and he even wants to tender apology before the informant.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. Considering the nature of allegation made in the F.I.R. as well as due to land dispute both the parties have filed case and counter case, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 19 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
