JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-03-2022 Heard Mr. Ajay Thakur, learned Advocate for the petitioner and Mr. Ram Priya Sharan Singh for the State. The counsel for the informant had appeared before this Court on the last occasion and had informed that he has no instructions in the matter to oppose the bail application.

The petitioner seeks bail in anticipation of his arrest in connection with Sadar P.S. Case No. 650 of 2019 dated 17.09.2019 instituted for the offences under Sections 341, 323, 448, 379, 504 and 506 of the Indian Penal Code, Section 12 of the POCSO Act and Section 66E of the Information Technology Act.

The petitioner along with five others is said to have entered the house of the informant during the absence of her

The learned counsel for the petitioner has submitted that the informant has filed several cases against many persons and that is the modus operandi of the informant and her husband to arm-twist and harass people. Since the petitioner was the whistle-blower, bringing to the fore the illegal activities of the informant and her husband, he too was made a target of their attack. For the reason of the informant being associated with some of the police functionaries, the subject FIR has been lodged against him.

During the course of investigation, nothing concrete could be collected against the petitioner. All that could be gleaned from the investigation papers is that such kind of accusation has been levelled against many persons. Considering the afore-noted facts, the provisional bail granted to the petitioner vide order dated 09.12.2019 is, hereby, confirmed.

The petitioner shall remain on the same bail bonds. The application stands allowed.
