2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 420, 406, 376, 506 and 34 of the Indian Penal Code .

3 . As per F.I.R., specific accusation of sexual assault and clicking obscene photographs of victim is against coaccused kalimullah Khan .

4. It is submitted on behalf of the petitioners that petitioner No. 1 is sister-in - law ( Saali) , petitioner No. 2 is brother-in - law ( Saala) and petitioner No. 3 is wife of co-

No.83553 of 2024(3) dt.27-01-2025 2/2 accused Kalimullah Khan and they have falsely been implicated in this case merely because they happens to be family members of the co-accused Kalimullah Khan against whom there is specific allegation of sexual assault and clicking obscene photographs of victim. So far as these petitioners are concerned, there is no specific allegation against them. Petitioners claim clean antecedent.

5 . Learned counsel for the State oppose the bail petition .

6 Considering the aforesaid facts, clean antecedents of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM East Champaran at Motihari in connection with Sugauli P.S. Case No. 243 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U T
