The petitioner seeks regular bail in connection with Phulpras P.S.Case no.61 of 2018 registered for offences punishable under Sections 147, 148, 149, 341, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. As per the FIR, allegation against the petitioner and other accused persons is that he surrounded the deceased and and the specific allegation of assault is against another co-accused , Sanjay Yadav.
Submission of the learned counsel for the petitioner is that considering the allegation that this Court has granted bail to another co-accused vide order dated 3.10.2018 passed in Cr. Misc. No.48369 of 2018. Petitioner is is custody for four
Patna High Court CR. MISC. No.77085 of 2019(2) dt.13-01-2020 2/2 months as well as the charge sheet has already been submitted. Heard learned A.P.P. learned counsel for the informant, who has opposed the prayer for bail stating that the petitioner and other accused persons surrounded and thereafter the deceased was killed by co-accused Sanjay Yadav.. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM II, Jhanjharpur, Madhubani in connection with Phulpras P.S.Case No.61 of 2018 dated 17.4.2018 .
With the above direction, this application is allowed.
