2. The petitioner apprehends his arrest in connection with Mednichowki P.S. Case No. 84 of 2023, registered for the offences punishable under Sections 341, 323, 307, 379, 504 of the Indian Penal Code.
3. The prosecution alleges that the petitioner along with others have brutally assaulted the informant and his son and wife, due to which all of them have sustained serious injuries. There is further allegation of snatching of valuable against the petitioner.
4. Learned Advocate for the petitioner submitted that the narratives of the FIR clearly suggest that on account of a trifle, the occurrence took place. It has not been alleged that in the occurrence any weapon has been used. The police after investigation submitted charge-sheet only under bailable

No.79185 of 2025(2) dt.01-12-2025 2/3 sections of the IPC, however, the learned court below has taken cognizance for the offences including the penal provision of Section 307 of the IPC vide order dated 22.02.2024. Some of the accused persons have not even been sent up for trial as Investigating Officer has found no material against them, which clearly speaks about false implication of some of the accused persons. The injuries which have been sustained to the son and the wife of the informant, these have been found to be simple in nature. So far as the injury which is sustained on the nose of the informant and found to be grievous in nature has not been specifically attributed to any of the accused persons. Taking note of the aforesaid facts co-accused Uday Kumar has been extended the privilege of anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 63347 of 2025 vide order dated 10.09.2025. The petitioner bears fair antecedent and he undertakes that he will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioner is facing the specific allegation of snatching of valuable besides the specific allegation of assault.
6. Regard being had to the submissions advanced by

No.79185 of 2025(2) dt.01-12-2025 3/3 the learned Advocates for the respective parties and considering the fact that the police after investigation submitted charge-sheet only under the bailable sections of the IPC, however, the learned court below has taken the cognizance of the offence including the penal provision of Section 307 of the IPC; besides the fact that the co-accused person facing identical allegation has been allowed the privilege of anticipatory bail by a coordinate Bench of this Court and the petitioner bears fair antecedent, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.
10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C., Lakhisarai, in connection with Mednichowki P.S. Case No. 84 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
