JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 Earlier prayer for bail of the petitioner was rejected by this Court twice firstly by order dated 10.9.2018 passed in Cr.Misc.No. 45446 of 2018 and secondly by order dated 1.5.2019 passed in Cr.Misc.No. 16776 of 2019 and there is allegation against the petitioner that he fired at the deceased, causing his death.

Submission of learned counsel for the petitioner is that he is in custody for more than three years and there is no substantial progress in the trial.

Heard learned APP and perused the report of learned trial court from which it appears that out of eight witnesses four have been examined.

In such view of the matter, I am not inclined to grant

Patna High Court CR. MISC. No.77542 of 2019(3) dt.26-02-2020 2/2 bail to the petitioner. However, since the petitioner is in custody for more than three years, learned trial court is directed to expedite the trial and try to conclude it within a period of six months.

With the above observation, this application is dismissed.
