JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition & Excise Act 2016.

Two four wheelers were intercepted and one person namely, RajKumar Sah caught by the police whereas three persons managed to escape from there. The illicit liquor was recovered from the aforesaid vehicle and the apprehended person disclosed that the aforesaid illicit liquor belongs to the petitioner. Moreover, petitioner does not have any criminal antecedent ,which evident from perusal of Para-3 of the petition. Considering the aforesaid facts and circumstances as

No.73443 of 2018(2) dt.20-12-2018 2/2 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bhojpur, Ara in Excise Case No. 1200 of 2018 arising out of Piro P.S.Case No. 255 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
