The petitioner seeks bail in Dehri Town P.S. Case No. 658 of 2018 registered under Sections 379, 411, 413, 414 and 34 of the Indian Penal Code.
The police intercepted a motorcycle on which three persons were riding. They disclosed their names as Chandan Kumar, Gautam Kumar and Raushan Kumar, the petitioner. Chandan Kumar disclosed in his statement made before the police that he along with the petitioner(Raushan Kumar) and Gautam Kumar committed theft of motorcycle.
The learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. There is no evidence that the petitioner committed theft of motorcycle. Chandan Kumar was driving motorcycle and petitioner was one of the
Patna High Court Cr.Misc. No.71758 of 2018(2) dt.10-12-2018 2/2 pillion riders. Petitioner has no knowledge about the theft of the motorcycle. Petitioner is in jail since 18.07.2018. Considering the nature of allegation made against the petitioner and the fact that petitioner has remained in jail for about five months and he has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri, Rohtas in connection with Dehri Town P.S. Case No.658 of 2018.
