2. In the present case, the petitioner seeks bail in connection with Kashichak P.S. Case No. 58 of 2025 dated 15.04.2025, registered for the offences punishable under Sections 126(2), 115(2), 76, 118(1), 118(2), 303(2), 352 and 351(2) read with Section 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.

As per the prosecution case, the petitioner threw a brick in the house of the informant and when the father-in-law of the informant opposed, the petitioner and other co-accused persons opened indiscriminate firing. Thereafter, they molested the informant and assaulted her with butt of a rifle making her unconscious. The brother-in-law of the informant was also assaulted with the butt of the rifle. Learned counsel appearing on behalf of the petitioner submits that there is case and counter version and fardbayan of the father of the petitioner was recorded at 11:30 AM on 15.04.2025, wherein he named the family members of the informant, as one Chandan Yadav shot at one of his son Chunchun Yadav and the Police came and took him to the hospital and the fardbayan of the father of the petitioner was recorded there, which was subsequently used to institute Kashichak P.S. Case No. 57 of 2025 and in order to create a defence, the present false and concocted case has been lodged by the other side and this falsity is apparent from the contents of the written report leading to institution of the FIR in the present case.
Both sides are next door neighbours and the petitioner and others were in hospital during the relevant time after assault by the informant's side and this also shows the falsity of allegation as the time of occurrence is stated to be around 07:30 PM. Learned counsel next submits that petitioner is having antecedent of two cases and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 29.08.2025.
5. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and

No.84049 of 2025(2) dt.09-12-2025 3/3 submissions made on behalf of the parties and considering the case and counter version and also considering the period of custody of the petitioner and submission of chargesheet, the petitioner, abovenamed, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Nawada / concerned Court, in connection with Kashichak P.S. Case No. 58 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
