This application for regular bail arises out of Silao P.S. Case No. 104 of 2019, disclosing offences under Sections 120 (B) and 302/34 of the Indian Penal Code.

The petitioner is brother of the deceased. The wife of the deceased has lodged the F.I.R. stating therein that there was dispute over partition in the family and all the family members had indiscriminately assaulted the deceased with sword, kulhari and other weapon.

Learned counsel appearing on behalf of the petitioner has submitted that mother of the deceased has also been implicated with specific allegation against her of having assaulted the deceased.

No.78301 of 2019(3) dt.06-03-2020 2/2 Be that as it may, since there is allegation of participation of the petitioner in commission of the offence as can be seen from the First Information Report, which led to the death of the deceased. I am not inclined to grant the petitioner, the privilege of regular bail, this application is dismissed at this stage.

The petitioner shall be at liberty to renew his prayer for bail after framing of charge.
