====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-01-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence under Sections 126(2), 115(2), 117(2), 109, 303(2), 352, 351(2), 3(5) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
3. As per the prosecution case, petitioner no. 1 & 2 snatched gold ornaments from the informant & his wife, petitioner no. 3 assaulted Beauty Kumari with brick and
Patna High Court CR. MISC. No.84599 of 2024(3) dt.28-01-2025 2/2 petitioner No. 4 & co-accused Madhupal Malakar assaulted wife of the informant with iron rod. Rest of the allegation is ornamental.
4. Learned counsel for the petitioners submits that as per injury report, the injuries, allegedly caused by petitioners, are simple in nature. There is case and counter case. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura in connection with Shekhopur Sarai P.S. Case No. 126 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
