2. In the present case, the petitioner seeks bail in connection with Chandi P.S. Case No. 121 of 2025 dated 27.07.2025, registered for the offences punishable under Section 109 read with Section 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.
3. As per the prosecution case, the co-accused took loan of rupees two lakhs from the informant and allowed him to cultivate his 9 katha land. Subsequently, the co-accused asked the informant to make further payment of rupees twelve lakhs for getting the land transferred in his name. On the date of occurrence, the co-accused persons along with this petitioner started ploughing the land which was earlier being cultivated by the informant in lieu of loan extended to co-accused Angad Kumar and when their act
Patna High Court CR. MISC. No.82356 of 2025(2) dt.03-12-2025 2/3 was opposed by the informant and his family members, coaccused fired upon the informant, who received gun shot injury in his shoulder. The allegation against this petitioner is that she arrived at the place of occurrence wielding a dab and extended threats.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and she has falsely been implicated in the present case being the wife of the main accused. The dispute is between the informant and co-accused Angad Kumar and she was merely a spectator at the place of occurrence. There is no allegation of any overt act against this petitioner. Nothing incriminating has been recovered from the person or possession of the petitioner. The person who was fired upon by the co-accused Arjun Kumar Singh did not receive any injury. In fact, there is no injury on Rohit Kumar. The co-accused namely, Arjun Kumar Singh has also been granted bail by this Court vide order dated 26.11.2025 passed in Cr. Misc. No. 77248 of 2025. Learned counsel next submits that petitioner is having antecedent of one case. Learned counsel lastly submits that petitioner is in custody since 04.08.2025.
5. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact

No.82356 of 2025(2) dt.03-12-2025 3/3 that there is no allegation of any overt act against this petitioner and also considering the grant of bail to the co-accused Arjun Kumar by this Court and further considering her period of custody, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bhojpur, Ara / concerned Court, in connection with Chandi P.S. Case No. 121 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
