The petitioner apprehends his arrest in Pipra P.S. case No. 67 of 2018 registered under Section 363, 366A/34 of the Indian Penal Code.

The mother of the victim made allegation that her daughter became traceless. During the course of search some articles and cash were also found missing. The informant further alleged that she suspected that Ashish Kumar with the help of his father and mother kidnapped her daughter. The learned counsel for the petitioner submits that petitioner happens to be father of Ashish Kumar, who is suspected to have kidnapped her daughter, but the victim was recovered and she made statement under Section 164 of the Cr. P.C. and disclosed that somebody injected her and kidnapped

Patna High Court Cr.Misc. No.74993 of 2018(2) dt.21-12-2018 2/2 her. She does not know Ashish Kumar.

Having considered the facts that save and except suspicion there appears no tangible evidence and even the victim did not disclose the name of Ashish Kumar as her kidnapper and petitioner is father of Ashish Kumar, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub divisional Judicial Magistrate, Patna in connection with Pipra P.S. case No. 67 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
