The petitioner apprehends her arrest in connection with Dulhin Bazar P.S. Case no. 51 of 2012, registered under Section 304(B) and 201 of the Indian Penal Code. The accusation is of killing of Sanju Devi, daughter of the informant Chand Bihari Paswan by her husband and in-laws due to non-fulfillment of demand of motorcycle as dowry and disposing of her dead body.

Learned counsel for the petitioner submits that petitioner is the Mausi of the deceased Sanju Devi, who was shown as witness, but during investigation the petitioner and Mayaka people of deceased Sanju Devi have been implicated in this case only on the ground that they had gone at the

Patna High Court CR. MISC. No.73161 of 2019(2) dt.21-11-2019 2/2 matrimonial house of Sanju Devi (deceased) and asked her not to come at Myaka due to that reason, she committed suicide. Further submission is that co-accused Malodhan Paswan and Nagwanti Devi, brother and Bhabhi of the deceased have already been allowed privilege of pre-arrest bail by a coordinate Bench of this Court on 29.06.2016 vide Criminal Miscellaneous No. 1075 of 2016. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-III, Danapur in connection with Dulhin Bazar P.S. Case No. 51 of 2012, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
