====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2024 Heard learned counsel for the petitioner and Mr. Umeshanand Pandit, learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with S.T. Case No. 150 of 2022 arising out of Srinagar P. S. Case No. 133/2021 in a case registered for the offence punishable under Section 302 of the Indian Penal Code.

3. As per the prosecution case, this petitioner assaulted the father of the informant with axe as a result of which he succumbed to the injury.

4. Learned counsel for the petitioner submits that during investigation four witnesses have been examined including the informant, who is son of the deceased, and none of them have supported the prosecution case. Informant is not an eye witness of the occurrence. Petitioner is in custody since

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 1st , Madhepura in connection with Srinagar P. S. Case No. 133 of 2021 corresponding to S.T. No. 150 of 2022/CIS No. 150 of 2022.
