The petitioner seeks regular bail in connection with Pirbahore P.S.Case No.311 of 2008 registered for offences punishable under Section 376 of Indian Penal Code. Allegation is of misuse of bail for eight years. Submission of the learned counsel for the petitioner is that as a matter of fact she married with the informant and now they are living together but due to lack of knowledge of the law, he could not make pairvi in this case as such his bail bond was cancelled and he was shown absconder. Now he has surrendered and he is in custody for more three months and ready to abide by any condition imposed upon him.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Manish Kumar -II, J.M. Ist class, Patna District Patna in connection with Pirbahore P.S.Case no.311 of 2008 with condition that he has to co-operate ein dispsoal fo the trial otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
