Petitioners apprehend their arrest in Kotwa P.S. Case No.18 of 2017, registered under Sections 147, 148, 149, 341, 323, 324, 354, 427, 379 and 504 of the Indian Penal Code. The informant alleged that on account of cutting bamboos, some altercation took place and the petitioners and others are alleged to have assaulted the informant and his family members. Bharat Ray is alleged to have given farsa blow on the head of the informant. The petitioner no.1 is said to have strip the cloth of the family members of the informant. Learned counsel for the petitioners submits that there is a counter version being Kotwa P.S. Case No.19 of 2017. There is specific allegation against Bharat Ray who has already

Patna High Court Cr.Misc. No.75767 of 2018(2) dt.21-12-2018 2/2 been granted bail. Other accused persons, Shyamlal Mahto and others have been granted anticipatory bail vide order passed in Cr. Misc. No.17084 of 2018. The case of the petitioners stands on the same footing.

Considering the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-X, Motihari in connection with Kotwa P.S. Case No.18 of 2017, subject to the conditions laid down under Section 438(2) Cr. P.C.
