The petitioner seeks bail in connection with Kanti P.S. Case No. 412 of 2018 instituted for the offence under Section(s) 363 of the Indian Penal Code. Later on Section 302, 385, 387 and 201 of the IPC was added Learned counsel for the petitioner submits that petitioner has clean antecedent. Petitioner is not named in the written report. The name of this petitioner has been disclosed by co-accused Dhananjay Kumar who has been arrested by the police in respect of kidnapping of the son of the informant who told that the victim was murdered and and he had kept the mobile phone of the deceased in the house of this petitioner.
Patna High Court Cr.Misc. No.72859 of 2018(3) dt.09-01-2019 2/2 Thereafter, mobile phone of the deceased was recovered from possession of this petitioner.
Learned counsel for the petitioner further submits that said Dhananjay Kumar, in his confessional statement before the police, has not alleged any overt act against this petitioner. He further points out that he along with Rajiv Ranjan @ Rajiv Kumar has committed the murder of the son of the informant. The petitioner is in custody since 21.07.2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, West Muzaffarpur in connection with Kanti P.S. Case No. 412 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/mu keshU T
