Petitioner is an accused in connection with Mokama P.S. Case No. 123 of 2015 for the offence registered under Sections 363, 366(A)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case on mere suspicion. It is further submitted that the victim girl in her statement recorded under Section 164 Cr.P.C. has stated that coaccused Nimesh Kumar on the point of pistol took her on his vehicle for Begusarai and kept there for 2-4 days and thereafter, she was threatened by the co-accused, Nimesh Kumar, to marry with the petitioner otherwise she will be killed, at that time petitioner's mother was also present there. Patna High Court CR. MISC. No.77058 of 2019(3) dt.05-03-2020 2/2 Delhi, Mathura and Faridabad along with two others by train where she lived 10-15 days but she did not raise any hulla during this period. She does not state anything against the petitioner. It is further submitted that the petitioner is aged about 18 years as per the medical report given by the doctor. Petitioner has no criminal antecedent and he is in custody since 07.08.2019.

Having considered the above facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., IV Barh, Patna in connection with Mokama P.S. Case No. 123 of 2015.
