2. The petitioner is in judicial custody in connection with Khagaria (Gangaur) P.S. Case No. 389 of 2024 for the offences punishable under Section 64 of BNS and Section 4 of POCSO Act, 2012 lodged on 26.07.2024 by the informant.

3. As per the prosecution story, the informant alleged that luring the victim four years old daughter of Rs. 2, allegation is that this petitioner took her inside, the room was closed. When there was delay in coming of the girl, the informant went to search, saw him taking her out, she accordingly, was convinced that the girl has been sexually assaulted which led to the FIR/arrest.

4. Though, learned counsel for the petitioner tried to impress upon the Court about the innocence of the petitioner,

No.84133 of 2024(2) dt.11-12-2024 2/2 learned APP has taken the Court to the order of the learned Sessions Judge to show, according to which, in the statement made later, the victim has also supported the prosecution witness. The petitioner is 55 years of age, the victim girl is 04 years old, she is almost the age of the grand daughter, the allegation is grave, in that background, no relief can be granted to the petitioner.
